What your notice must include
To meet 17 U.S.C. § 512(c)(3) (and similar laws elsewhere), please include:
- Your physical or electronic signature.
- Identification of the work you say is infringed.
- The infringing material and where it appears (the bid title, or a screenshot and time).
- Your name, address, phone number and email.
- A statement that you believe in good faith the use is not authorised by you, your agent or the law.
- A statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner.
Counter-notice
If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice with the information required by 17 U.S.C. § 512(g)(3). Unless the complainant tells us they have started court action, we may restore the content after 10 to 14 business days.
Repeat infringers
We block bidders who repeatedly infringe others’ rights.
Sending a knowingly false notice or counter-notice may make you liable for damages under 17 U.S.C. § 512(f).
