Terms of Service
The short version. Sellers pay QwikBuy to put one discounted product in their country’s spotlight until someone outbids them. Shoppers click through and buy from the seller, not from us. Sellers must list real products at real discounts. Being outbid isn’t refundable. The full Terms below are what legally apply.
1. Who we are
qwikbuy.lol (“QwikBuy”, “we”, “us”) is operated by Olasunkanmi Fafowora, trading as QwikBuy, Lagos, Nigeria. Contact: legal@qwikbuy.lol.
2. Accepting these Terms
These Terms apply when you use the site. Sellers must also tick boxes agreeing to these Terms, the Content Policy and the Refund Policy, and confirming the deal is genuine. Every listing records which version was accepted. If you don’t agree, don’t use the site.
3. What QwikBuy is (and isn’t)
- QwikBuy is an advertising space. Each country has one spotlight. A seller pays to display a listing there (product name, photo, store name, usual price, QwikBuy price, optional promo code and a link to buy).
- QwikBuy is not the seller and is not a party to any purchase. We don’t hold stock, take payment for products, ship goods or handle returns. Any purchase is a contract between the shopper and the seller, on the seller’s own website and under the seller’s terms.
- We check that each link opens and record the website it really lands on, which we show to shoppers. We do not verify products, prices, stock, quality or delivery, and we don’t guarantee any seller.
- Bidding for the spotlight is not gambling, a lottery, a contest or an investment. There is no prize and no element of chance, and nothing can be won or cashed out. QwikBuy never pays money out to users.
4. Eligibility
You must be 18 or older and able to enter a binding contract. Don’t use QwikBuy where the law doesn’t allow it, or if you’re subject to sanctions. If you list for a business, you confirm you have authority to bind it.
5. The spotlight and bidding
- Your listing appears in the spotlight for the country you chose, from the moment Paystack confirms your payment until another confirmed bid replaces it or the day ends (midnight in the country’s main time zone), whichever comes first. You might be outbid within seconds; we don’t guarantee any minimum time, views, clicks or sales.
- Bids start at ₦1,000. To replace a listing featured today you must bid at least ₦500 more than it when you start checkout. The maximum bid is ₦5,000,000.
- Daily reset: at midnight in the country’s main time zone the live listing ends and the spot reopens from ₦1,000. The countdown shown on the site is when this happens.
- Bids are ranked when payment is confirmed. If an equal or higher bid confirms before yours, your listing doesn’t go live and you’re refunded under the Refund Policy.
- After a listing is replaced, it stays visible under “Previously featured” (Recent, Today’s top and All-time top) with its link still active. We may change how these lists are ranked or shown.
- Spotlight bids are charged in Nigerian naira (NGN) through Paystack. If you pay with a foreign card, your card issuer converts the amount and may add fees.
6. Sellers’ promises
By listing a deal you promise that:
- The discount is real. The “usual price” is a price you genuinely charged recently, and the QwikBuy price (and any promo code) works for shoppers who come from QwikBuy while your listing is live.
- You own or are allowed to sell the product, and it is legal to sell where you list it.
- Your description and photo are accurate, including the product’s condition.
- You will deliver what you sell and handle payments, refunds, warranties and complaints under the consumer laws that apply to you, including the Federal Competition and Consumer Protection Act if you sell in Nigeria.
- You own or have permission to use the photo, name and any trademarks in your listing.
- Your listing follows the Content Policy. In particular, QwikBuy never allows betting or gambling, or sexual or adult content, in any country, even where they are legal or licensed.
- If your listing points to a social profile or WhatsApp, the account is yours or you’re authorised to use it, and what buyers find there also follows the Content Policy.
Listings stay on QwikBuy after they leave the spotlight. If an item sells out, it’s your job to show that on your own site. Shoppers are told that prices were correct when featured and to check availability with you.
7. Shoppers
Read the seller’s terms before you buy. If something goes wrong with a purchase, contact the seller. If you think a listing is fake, misleading or a scam, report it. We may remove it, but we can’t refund purchases you made from a seller.
8. Payments
Spotlight payments are processed by Paystack (paystack.com) under its own terms. We never receive or store your full card or bank details. Taxes, if any apply, are shown at checkout.
9. Licence to your listing
You keep ownership of your listing content. You give QwikBuy a worldwide, royalty-free, non-exclusive licence to host, display, resize and reproduce it on the site and in screenshots, social posts and press about QwikBuy, for as long as we operate the site.
10. Moderation and removal
We may review, refuse, hide or remove any listing at any time, with or without notice. This includes listings we reasonably believe are fake, misleading or a scam, break these Terms or the law, are the subject of a valid complaint, or put people at risk. If we remove a listing because it broke our rules, you won’t get a refund, and its bid still counts as the price to beat that day. We may block anyone who abuses the service.
11. Chargebacks and fraud
Contact us first if you think you were charged wrongly. A chargeback filed in bad faith for a placement that was delivered breaches these Terms. If that happens, we may remove the listing, block future listings, and dispute the chargeback with evidence such as your acceptance record and the placement history.
12. Acceptable use
Don’t interfere with the site or its security. That includes scraping at a disruptive rate, flooding the live connection, getting around bid rules, using bots, or probing for vulnerabilities without permission. Report security issues to abuse@qwikbuy.lol.
13. Our intellectual property
The QwikBuy name, logo, design and code belong to Olasunkanmi Fafowora. You may share screenshots and links to QwikBuy.
14. Disclaimers
The site is provided “as is” and “as available”. As far as the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. “Live” means as fast as the internet allows: outages and delays can happen.
15. Limitation of liability
As far as the law allows, QwikBuy is not liable for indirect, incidental, special, consequential or punitive damages, for lost profits, revenue, data or goodwill, or for any product, purchase, seller or website linked from a listing. Our total liability for any claim is limited to the greater of (a) what you paid us in the 3 months before the claim and (b) US$100. Nothing here limits liability that can’t legally be limited, such as liability for fraud or for death or personal injury caused by negligence.
16. Indemnity
Sellers will defend and indemnify QwikBuy against third-party claims, losses and reasonable legal fees arising from their listing, their products or sales, their website, or their breach of these Terms or the law.
17. Consumers
If you’re a consumer, you may have mandatory rights under local law, for example in Nigeria, the EU or the UK. These Terms don’t take those rights away. A spotlight placement is delivered immediately on payment. Where the law gives a cooling-off right for digital services, you agree that you lose it once your listing goes live.
18. Changes
We may update these Terms. Changes apply to listings created after the effective date, and every listing records the version accepted.
19. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes go to the courts of Lagos State, Nigeria, unless mandatory consumer law lets you bring proceedings where you live. Please email legal@qwikbuy.lol first and give us 30 days to try to resolve it.
20. General
If any part of these Terms is unenforceable, the rest still applies. If we don’t enforce a right straight away, we haven’t waived it. You may not transfer your rights under these Terms. These Terms and the policies linked above are the entire agreement between you and QwikBuy about the service.
